The WTO dispute settlement mechanism: coverage and procedures of the WTO understanding
Article Abstract:
The international trade dispute resolution methods established under the Understanding on Rules and Procedures Governing the Settlement of Disputes combine negotiatory and adjudicatory mechanisms. The Understanding takes effect on Jan 1, 1995, as a component of the World Trade Organization Agreement. The meshing of legal and diplomatic remedies may result in the politicization of the legal process, but the Understanding does provide substantive reforms such as unilateral retaliation prohibition, implementation monitoring and use of the negative consensus rule.

Japan's first antidumping measures in the Ferro-Silico-Manganese case

Japan adopted antidumping measures for the first time in January 1993, attracting attention due to the country's history of criticizing the antidumping measures of its trading partners. This may signal a shift towards more multilateral trade and an acceptance of GATT rules, and a move away from the country's tendency to make different trade deals with various countries. The move may result in antidumping petitions by domestic protectionists. It was a political maneuver, and may have been done to satisfy a petitioner. Japan's antidumping laws are discussed.

Reasonable expectations and non-violation complaints in GATT/WTO jurisprudence
Article Abstract:
The principle guiding the decision of the World Trade Organization's trade dispute settlement panel is that of the principle of reasonable expectations of the parties involved in the dispute. The principle is based on the objective of the General Agreement on Tariffs and Trade which implies the full socio-economic development of all participating nations via trade. Both the principle and the implied objective form the basis of decisions, which provides a form of structure to the decision despite a non-codification of the decisions into a formal rule.
