The beginning of the end of peremptory challenges
Article Abstract:
The US Supreme Court in Georgia v McCollum prohibited racially-based use of peremptory challenges by a criminal defendant. The court held that it was a state action in violation of the Equal Protection Clause. However, the ruling favors the rights of jurors over those of criminal defendants, which is contrary to the constitutional system of giving extra protection to defendants in recognition of their unequal position and greater stake in the outcome of the trial. Criminal defendants should not be considered state actors, and their right to peremptory challenges should be preserved.
