The author discusses the doctrinal aspects of the U.S. Supreme Court 1999 case Saenz v. Roe, where the Court revived the use of the Privileges and Immunities clause of the 14th Amendment in the context of a state residency requirement. The fundamental rights approach, doctrinal changes, and implications for the future are included in the discussion.
