The removal of squatters from commercial premises through the UK civil courts can take up to 72 hours, once the order for possession has been awarded by the courts. A valid title to the property must be established before the court will proceed. An alternative strategy to remove squatters is by proving they have caused criminal damage to the property and therefore are liable for arrest by the police. If the squatters are behaving in such a way as to be considered abusive the police can remove them as they are contravening the Criminal Justice and Public Order Act 1994.

Judgment day at Rochdale

The High Court has quashed the decision of the local council in Rochdale, England, to grant planning consent for Wilson Bowden's Kingsway Business Park near the M62 in the town. The main element in the success of those who opposed the scheme was their use of the European Directive on Environmental Assessment. Wilson Bowden, which gained 30 million pounds sterling from English Partnerships and the European Regional Development Fund to support its scheme, plans to return to the local authority for consent to be granted once again.

A new broom sweeps clean

The U.K.'s new Environment Act, which comes into force on 1 Apr, 1996, defines contaminated land as that which could threaten to pollute rivers, underground waters or lakes. The act's key principle is that the polluter, defined as the person who caused or knowingly permitted the pollution to happen, is liable. The act implies that managing agents and surveyors may be liable. The act and its consequences for the commercial property sector are discussed.
