Article Abstract:

Planning permission can be refused on unreasonable grounds in cases of appeal. The Court of Appeal always considers public complaints about proposed development programmes even if they are totally groundless. Issues involving noise and pollution are commonplace in court. The cases of Newport County Borough Council verses Secretary of State for Wales and Browning Ferris Environmental Services Ltd is considered.
