Article Abstract:
Title III of the ADA places important risks and liabilities on real estate investors. Four threshold issues are involved: occupation of the facility by a public accommodation, achievability of removal of barriers, alterations that trigger need for compliance and affect on area of primary function. Leases and contracts should clearly allocate compliance responsibility among tenants, landlords, lenders, purchasers and contractors.

The move to deregulation will be phased regionally and locally, with new areas opening up in stages from September.
