New Routes for Title Insurers

Article Abstract:

Innovative lending practices, developed during the last few years, have created problems for title insurers. Most of these problems revolve around the legal concept of 'clogging of the equity of redemption'. Basically this phrase refers to a hindrance on the mortgagees right to redeem his property under various conditions and circumstances. With traditional methods of mortgage lending this right of redemption was clearly understood. The new creative financing packages being developed, however, blur the right of redemption and will require some time and continued care before title insurers will have established clear cut guidelines.
