Article Abstract:

The High Court decision in the case of R v Leicester City Council, ex parte Powergen UK plc raises doubts about the ability of developers working on large schemes to seek approval of reserved matters on a piecemeal basis. If condition 2 of the planning permission for the scheme in question, which required the submission of the reserved matters for the development and that approval be obtained before the development began, is interpreted as the decision suggests, then piecemeal applications would not comply with the condition on the outline planning permission. It is difficult to reconcile this decision with the judgment in Heron Corp Ltd v Manchester City Council.

Time warped

Article Abstract:

Two recent cases indicate the importance of being aware that UK courts can sometimes make changes to statutory time-limits for making challenges to planning decisions. For challenges that do not come within the scope of Part XII of the Town and Country Planning Act 1990, the procedure is determined by the principles of judicial review contained in Ord 53 of the Rules of the Supreme Court. It is not correct to interpret ORd 53 as stating that challenges by way of judicial review must be brought within three months.
