Overriding the highway

Article Abstract:

The case of R v Cardiff County Council ex parte Sears Group Properties Ltd gives a clear insight into the relationship within the UK planning process between a highway authority's powers and those of the planning authority which has ultimate responsibility for deciding on planning applications. This case was decided on the broad principle that, where a formal decision has been made on a specific matter or issue influencing private rights by a public body, that decision should be binding on other public bodies involved, unless circumstances change in such as way as to alter the basis of the original decision.
