Article Abstract:

A UK legal case involving rates due on unoccupied real estate was brought by Barnet London Borough Council, England against London Transport Property. The council argued that the company should pay rates for the FY 1992-1993. The company claimed exemption, and a magistrate argued that the exemption should be granted. The appeal by the council was allowed following a debate on the meaning of the term storage. Buses were kept in the property, and there were in active service, so this was not seen as storage.

Development: present occupiers' rights

Article Abstract:

A UK legal case involving occupiers' rights on land beside a canal resulted in a decision that the Act of Parliament of 1793 by which the canal was built applied to later owners as well as the original owners. The High Court also ruled that single bank owners were affected by the Act, as well as owners of land on either side of the canal. The case involved British Waterways Board versus Swan Hill Developments and other owners of land in the canal area.

Newham London Borough Council v Secretary of State for the Environment and another

Article Abstract:

A UK legal case involved a breach of local authority planning controls when a house in London, England, was turned into two apartments without planning permission being obtained for the change of use. The local authority's decision to issue an enforcement notice was appealed against and the appeal allowed by the Secretary of State for the Environment. The local council then appealed against the Secretary of State's decision, but lost this appeal.
