Changing the rules

Article Abstract:

There is some conflict between the Landlord and Tenant Act 1954 Part II and the Civil Procedure Rules 1998. This could be solved by the revision of the 1954 act. In the meantime, it is probable that tenants and landlords will agree renewal terms without resorting to the courts, possibly through the Professional Arbitration on Court Terms, which is ideal for this situation.

Reflections of discontent

Article Abstract:

Four planning cases challenged the decisions made by the Secretary of State for the Environment in the UK, following planning applications which had not been successful. A case involving a gypsy family living on a piece of land purchased by the family had been brought to the attention of the European Court of Human Rights. The UK courts disagreed with the European Court and held that the family should move to an official site. A second case dealt with the probation service who wanted to extend its premises but were refused permission because larger premises would disturb the neighbours.

Short and to the point

Article Abstract:

The British Property Federation have devised a readable and short standard-form lease for commercial properties. It is aimed at short-term agreements. The lease can be used for a variety of premises, such as part of an estate, a whole building or part of a building. Landlords are obligated to provide the services as stated in the lease and tenants are expected to take care of the property but not to make repairs. Rents are included in the lease and the cost of insurance and services but not value added tax. They are fixed for the whole lease period.
