Article Abstract:

A UK legal case involving valuation of real estate resulted in a decision that 29 experts with knowledge of the locality should be selected to assess the value of 29 real properties in avrious UK locations. The plaintiff in the case sought the appointment of a valuation expert by the court, and the plaintiff won this case. This was seen as the best way to achieve a rapid resolution of the issue. The case involved Abbey National Mortgages taking action against Key Surveyors Nationwide, among others.

Dudley Port Warehousing Co Ltd v Gardner Transport and Distribution Ltd

Article Abstract:

A UK legal dispute over breach of a license concerned the letting of storage space by the plaintiff who did not carry out work despite promises in the contract with the defendant. The defendant claimed that non-fulfilment of these obligations meant that they did not have to pay the agreed license fee. The appeal court found in favor of the plaintiff since the defendant had continued to occupy the premises. The defendant could claim damages but was obliged to pay the plaintiff the license fee.

Thornfield Roadside Ltd v Secretary of State for the Environment and another

Article Abstract:

A UK legal case involved a request for planning permission for a service area following the realignment of a highway. Permission was not granted since drivers already had enough facilities and there were restrictions on building in the countryside. The applicants had promised that they would not start building until the road works had been carried out, but the request for planning permission was seen as premature. The applicants' appeal was refused.
