Two steps forward, one step back: the Supreme Court's treatment of teacher-student sexual harassment
Article Abstract:
The Supreme Court, in Gebser v. Lago Vista Independent School District, erred in failing to require a school district to pay damages to a student who had been sexually harassed by a teacher. The district was held not liable for the teacher's actions because it was not shown to have had actual notice of the harassment and to have acted with deliberate indifference to such notice. The Court's ruling prevents Title IX harassment claims from being effectively enforced against school districts.

Recognizing a cause of action under Title IX for student-student sexual harassment
Article Abstract:
Title IX of the Education Amendments of 1972, which prohibits discrimination on the basis of sex, should be read as requiring school districts to be held liable for failing to respond to incidents of student-student sexual harassment. Although the courts differ on the question of student-student harassment, Title IX clearly allows plaintiffs to recover monetary damages when a school district "intentionally" fails to take remedial action to remedy instances of known sexual harassment.
