Inheritance law in aging society
Article Abstract:
Analysis of the modifications in inheritance laws during 1961-90 to establish the changing trends reveals that states reform their laws in line with the law community's Uniform Probate Code. One third of states adopted the Code in its entirety. The shift from a traditional, paternalistic law to a more flexible facilitative law allows greater independence and decision-making. The implications for older households in reducing family disputes, preserving assets, and enabling better property division are discussed.
