Piercing the corporate veil
Article Abstract:
The "piercing the corporate veil" approach allows a litigant to obtain retribution from the company's owners. The approach is being extended to environmental laws as reflected by a court ruling of a parent company liability in the US versus Cordova Chemical Company hazardous waste disposal case. The decision went in favor of Cordova parent company citing weak evidence to support claims that the parent company was liable under the "piercing the corporate veil" provision, when it had not directly intervened in the operation and management of its subsidiary.
