Getting in the act

Article Abstract:

The Ontario provincial government has enacted into law a new bill on franchised business that is modeled after the Alberta Act. Franchisees and franchisors may expect the new legislation to affect franchise operations on a day-to-day basis. One key feature of the new Ontario Act is the imposition of a 'duty of fair dealing' on both parties to the franchise agreement. It also gives either party the right to sue for damages if this duty of fair dealing is breached.
