Article Abstract:
The U.S. court appeals that the Silveira opinion was ill advised and wrong and that the Ninth Circuit's prior Second Amendment cases should be reviewed is discussed. The decision written by Judge Diarmuid O'Scannlain and joined by judges Arthur Alarcon and Ronald Gould noted that the individual right view of the Second Amendment has enjoyed recent widespread academic endorsement and disparaged the recent decision by another panel of the same court.
