Does NEPA apply to critical habitat designations? Ninth and tenth circuit courts disagree

Article Abstract:

The ninth circuit court opposes the documentation of critical habitat designation under the National Environmental Policy Act (NEPA), while the tenth circuit court offers a favourable decision. The documentation is also required under the Endangered Species Act (ESA). An evaluation of the two decisions shows that the tenth circuit court's decision is flawed. Habitat protection of the endangered species will become increasingly difficult if both NEPA and ESA documentation are required. For ensuring habitat protection, it is essential to give priority to the ninth circuit decision.

Strange bedfellows: observations on the current relationship between recovery plans and habitat conservation planning

Article Abstract:

A study was conducted to examine the interaction between recovery and habitat conservation plans (HCP), provisions of the Endangered Species Act (ESA) Amendments of 1982. Data from the National Center for Ecological Analysis and Synthesis and the American Institute for Biological Sciences research during the fall of 1997 were used. It aimed to resolve the debate over the conflicting interest between recovery plans and HCPs. However, findings revealed that HCPs are valuable tools in a species' recovery plan. Both provide coordinated protection for endangered species.

Bringing people into population and habitat viability analyses

Article Abstract:

An effective workshop process has been designed by the Conservation Breeding Specialist Group (CBSG), a division of IUCN's Species Survival Commission. These workshops identify endangered species and formulate research and management solutions such as the Population and Habitat Viability Assessment (PHVA). The PHVA aims to examine a particular species and its habitat to arrive at specific measures of conservation and sustainable management practices. A collaboration was established to strengthen the demographical and social components of the study.
