Researchers caught in dispute over transgenic mice patents
Article Abstract:
Irish biotechnology firm Elan Pharmaceuticals is taking legal action against the Mayo Foundation for Medical Education and Research over mice used in Alzheimer's disease research. Elan claims that Mayo has violated two patents it holds on transgenic mice with a mutation that leads to Alzheimer's disease. Mayo claims that the Elan patents were fraudulently gained from the US Patent and Trademark Office. This case is causing concern among US neuroscientists because some are being required to testify in depositions for Elan's civil lawsuit. Some observers believe that the case is having a negative impact on research into Alzheimer's disease.

Roche's Taq patent 'obtained by deceit', rules US court
Article Abstract:
US district judge Vaughn Walker has ruled that there were eight instances in which scientists working for Hoffmann-La Roche deliberately sought to mislead the US Patent and Trademark Office in order to gain the patent for the naturally occurring form of the reagent Taq DNA polymerase. The scientists made misleading statements or withheld information during the patent office's review process. This ruling resulted from a legal battle in which Roche accused Promega Corp of infringing its patent by selling its own native Taq to researchers.

Issues are presented concerning the attempt by Elan Pharmaceuticals, Inc. to patent its transgenic mice and prevent their use by neuroscientists in other organisations. The patent claims were disallowed by the US District Court in San Francisco, CA.
