ALTHOUGH OPPOSED BY THE INSURANCE INDUSTRY ON GROUNDS OF UNFAIR COMPETITION, LEGISLATION WITH ADMINISTRATION BACKING IS PENDING WHICH WOULD ALLOW THE FORMATION OF GROUPS OFFERING ALTERNATIVE INSURANCE COVERAGE. THE GROUPS COULD BE MADE UP OF MANUFACTURERS, DISTRIBUTORS AND RETAILERS AND WOULD SERVE COMPANIES WITH HIGH DEDUCTIBLE INSURANCE OR THOSE UNABLE TO OBTAIN ANY.

ANTI COMPETITIVE EFFECTS ON BUSINESS WOULD HAVE TO BE CONSIDERED BEFORE GOVERNMENT REGULATORY AGENCIES COULD ISSUE NEW RULES ACCORDING TO A PROPOSED BILL. THE ENVIRONMENTAL PROTECTION AGENCY AND THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION BOTH WOULD BE REQUIRED TO CHOOSE THE PATH WITH THE LEAST NEGATIVE IMPACT ON COMPETITION.

Incorporation does not automatically prevent business owners, shareholders and directors from being held personally liable for business-related matters. Situations that increase the likelihood of liability include the commingling of assets, undercapitalization and the lack of records.
