Putting teeth into NAFTA's "fair treatment" provisions: Mexico must do more to protect foreign investors, or pay, NAFTA panel rules

Two international law attorneys discuss a decision by an international law panel that Mexico violated the North American Free Trade Agreement by not providing fair an equitable treatment to an American company, Metalclad, which operated a hazardous waste facility. Topics include the panel's $17 mil award to the company, regulations for construction permits, and claims by Metalclad that Mexico prevented the opening of Metalclad's hazardous waste landfill.
