A world court for criminals

Article Abstract:

An investigation has been called by the Pentagon into events in the Korean War in 1950 when US troops allegedly shot large numbers of villagers. US soldiers have since become more conscious of the need to prevent deaths of civilians in war. The US should not oppose the setting up of an international civilian court. There is a need for universal justice, but the US only supports such measures if it is not included, and there are fears of international bodies that are not directly controlled by the US. This is a hypocritical and misconceived position, especially after US intervention in Kosovo, Yugoslavia, which undermines abolute claims to sovereignty.

A challenge to impunity

Article Abstract:

The US has sought to prevent the establishment of an international criminal court, but the project has gone ahead without the US. The US sought to ensure that its citizens would not appear before such a court on charges related to war crimes, but such assurances could not be given. There are weaknesses which could hamper the court, such as a seven-year opt-out provision, but the court could still be successful. Treaty ratifications will take some years, but when the court is functioning governments will be obliged to explain why they are not co-operating with it.
