AUSTRIA/US: LAWYER WARNS KAPRUN ACCIDENT FIRMS

Article Abstract:

Ed Fagan, the US lawyer, says that companies involved in the ground funicular train accident in Kaprun, Austria, on 11 November 2000 could be faced with damage claims worth hundreds of million US dollars. Fagan represents families of the 8 US victims of the accident. The companies involved are Gletscherbahnen Kaprun , Osterreichische Elektrizitatswirtschafts-AG and Waagner-Biro, Swoboda Karosserie und Stahlbau Gesellschaft mbH and the US-Italian company Leitner. Since Austria and the US have no such bilateral agreement, any claims accepted by a US court could not be executed in Austria. However, any assets of the companies in the US could be affected. A judge at New York South district court ruled that the claimants have to be given access to evidence and witnesses of the accident.

Following four small fires in the underground in the last few months, the Vienna local transport company Wiener Linien is replacing all filter mats on the underground trains. The company is also considering to install protective grating around the filters on train roofs. The fires were probably caused by dust on the filters, possibly ignited by a cigarette.
