Activism in different robes

Article Abstract:

US courts have changed relations between states and federal government. The Supreme Court decided that state governments cannot be sued for the violation of patents, through federal courts, or in state courts for breaching laws of the federal government. The best way to achieve a balance between federal government and US states has been through political means rather than through law courts. There should be concern if states can be beyond the law.
