Free movement of goods

Article Abstract:

The EC's Treaty embodying the creation of the European Economic Area has as one of its prime objectives the establishment of a common market where there is the free flow of goods, services, persons and capital and the absence of internal borders. Based on Article 30 of the said EC Treaty, quantitative restrictions applicable to import and export products are rendered unapplicable. Possible exceptions to Article 30 are contained in Article 36. The Cassis de Dijon case in Germany is used to illustrate the applicability of Article 30 as shown in the incompatibility of German legislation to the EC Treaty.

ANC delivers the goods

Article Abstract:

The 1995 management buyout (MBO) of UK express parcel delivery company ANC Holdings proved a challenging deal for Montagu Private Equity (MPE), which led and structured the 50 million pounds sterling deal. The MBO, from Securum UK Holdings, presented MPE with several challenges, for example beating the tough competition from other venture capitalists; and then making sure that after the deal, ANC would be able to compete effectively in the rapidly growing express parcels delivery market. As part of this, MPE arranged finance for a capital investment project.
