Article Abstract:

The Korean Constitutional Court has been proven an effective body toward a possible reunification of North and South Korea. Created in 1988, the Court has shown adherence to democracy and judicial processes. The Constitutional Court's decisions have shown unbiased and progressive views on election issues and constitutional rights. However, it has yet to overrule oppressive laws and show efficiency in making the executive branch adhere to Court decisions. These may be effected only if the court is granted contempt powers.

Vietnam is not a copycat

Article Abstract:

Vietnam recognizes the importance of intellectual-property protection and has one of the best regimes in the region for protecting trademarks. It is still working to implement a new copyright law, and must soon revise its patent laws and regulations governing technology transfer. The National Office of Industrial Property is an excellent central body for patents and trademarks, with transparent, efficient operation. Other govts can help by training Vietnam's customs officers, and businesses can educate the public.

Article Abstract:

Vietnam must greatly revise and extend its legal system, making it more friendly to the market, if it is to create the sort of market economy it claims to want. It has made advances in formulating the Civil Code, and the absence of firecrackers during Tet testifies to the growing grass-roots power of the law. However, the recent withdrawals of several major companies and the low ratio of actual foreign investment versus what is committed both indicate the business community's skepticism and bad experiences.
