Article Abstract:

The findings of four legal cases relevant to architects in the United Kingdom are presented. The case of Regalian Properties versus London Dockland Development Corporation finds that another party cannot be sued for the recovery of money spent in anticipation of securing a contract. The case of National Rivers authority versus Alfred McAlpine Homes East Ltd finds that a firm can be criminally liable for the actions of its employees. The case of Cambridge Water Company versus Eastern Counties Leather finds that unforeseeable damage can be a defence in a strict liability situation.

The law as it affects architects

Article Abstract:

Recent court cases show the difficulties concerning contract administration for contractors, architects and customers. The case of Roger Gibbs vs Roger Tomlinson brings up the subject of time stipulations in contracts, and the fact that a party seeking arbitration cannot refuse to finish a job pending the outcome. Nine other cases involving construction of buildings are also discussed.

Article Abstract:

Legal cases heard during 1992 and early 1993 that affect architects are reported. The cases concern contract clauses, collateral warranties, land ownership, planning, unauthorised alterations to buildings and negligence.
