Natural justice has failed to kill off the adjudication process

Article Abstract:

The growth of natural justice challenges to adjudication decisions indicated that the process itself was inherently unfair, unless everyone would be given an opportunity to air their opinion and the case was limited to that presented at the outset or the timetable was extended to accommodate any changes. If adjudicators are required to give reasons for their decisions, a brief statement of reasons is all that is required.

According to Kim Franklin, as early as 1553 the courts first realized the need for expert evidence in cases that concerned what were known as 'other sciences'. The main theme of expert evidence in the 21st century is the overriding duty to assist the court.
