The Pinochet case: bringing the general to justice

Article Abstract:

Former Chilean despot, Augusto Pinochet, has been arrested in London, England, and the legal battles since the arrest have shown that international law and its relationship with national law are still developing. The UK House of Lords judicial committee has decided that Pinochet does not have immunity from arrest due to haveing been Chile's head of state, since torture and murder are not part of the functions of a government head. The UK home secretary has to decide whether to allow the extradition hearing to take place, and Pinochet could be permitted to go back to Chile for compassionate reasons.
