The new act: a bluffer's guide

Article Abstract:

The UK Construction Act 1998 has come into force and is attracting much interest. It sets out provisions for the appointment of an adjudicator to settle differences related to a written construction contract. It defines construction contracts for the first time, excluding contracts related to certain types of projects including drilling works, artistic pieces and contracts with residential occupiers, but including management and professional contracts. The Act raises a number of issues for debate including what overall effect it will have on the construction industry.

New thinking on non-payment

Article Abstract:

The UK Construction Act of 1998 includes provisions concerning payment. All contracts covering work which will take longer than 45 days should include provisions for periodic payment. Any contract which does not include specific provisions will be subject to the government's provisions. The Act identifies a number of different dates which contracts could specify for payments, and it gives contractors new rights to stop work if payment is not made.
