When witnesses make statements

Article Abstract:

A statement was traditionally taken from a client before the commencement of proceedings, and used as the basis on which the case was pleaded. Rules were recently introduced that required witness statements to stand as the witness's evidence in chief, to save the court time. A written statement could disguises uncertainties with regard to a witness's evidence and the actual preparation of a statement is a considerable undertaking. The Technology and Construction Court calls for witness statements to be produced following the exchange of expert evidence.

Law can be more inconvenient than inconvenience itself

Article Abstract:

The UK legal system is heavily weighted towards financially secure firms who wish to take legal action and issue writs. Private individuals may find the cost of taking someone court is prohibitive. A private person can not claim damages for the stress and strain involved in taking a case to court, although they can claim for mental stress suffered because of the action of another individual or company.

Chasing payment through the courts, or send the boys round

Article Abstract:

Legal advice is presented on how British architects can extract money legally from clients who won't pay. The first round of options includes issuing a claim form, issuing a statutory demand, and, if the contract is a construction contract, starting a notice of adjudication under the United Kingdom's Housing Grants Act and the Scheme for Construction Contracts.
