Article Abstract:

Canadian legislators have struggled to draft amendments that ensure children of financial support in the event of parent separation or divorce. One of the most widely debated issues is the implementation of the so-called Paras formula. This scheme is based on the principle that child support must be determined relative to both parents' income. However, the formula has been opposed by many due to the inconsistencies committed in assigning tax factors and certain flaws in the formula itself. Eventually, another set of new guidelines, based on the Thibaudeau factor, was implemented. These guidelines aim to standardize child support awards in various regions.

Retirement reckoning: should pensions help us to maintain our pre-retirement incomes, or help governments to redistribute income from the rich people to the poor?

Article Abstract:

The Canada Pension Plan (CCP)'s purpose appears to have shifted over the years from income maintenance to income redistribution. Instead of pensions helping maintain incomes prior to retirement and thus avoiding disruption in standards of living upon retirement, pensions seem to have become government's tools to redistribute income from the rich to the poor. For instance, the contribution limits of RRSPs compel Canadians to invest part of their retirement savings outside of tax shelter. The recent changes to the CCP will ironically slash government revenues just when it needs plenty of resources at its disposal for the retired sector.

Spousal support remains one of the most challenging issues faced by family courts with the awarding of support performed on a case-to-case basis. For instance, indefinite spousal support is granted based on the dependent's needs and payer's ability. Time-limited support is often awarded when marriages are short-term while indefinite 'top-up' support means that support continues until dependents have found suitable employment.
