Smoking in the workplace - a growing dilemma

Article Abstract:

About 30% of US companies have a full or partial ban on smoking. Companies wishing to initiate such a policy should consider: management and employee attitudes; type of company products and necessary operations; legal and insurance requirements; union agreements and employee reassignment policies; customer relations; and physical layout of building and ventilation systems. Smoking policies should include mention of purpose and background, general policy statements, enforcement, and education and training. Smoking policies may be implemented by getting employees and management involved; announcing union support, where applicable; stressing health reasons for the policy; promoting nonsmoking as normal behavior; taking time in launching the program; making sure every employee gets a policy copy; and conducting meetings.

Protecting your business from employment negligence

Article Abstract:

Companies should take steps to reduce their liability for crimes committed by their employees while on the job. The sources of liability recognized by the states through court rulings include negligent hiring, negligent supervision, and negligent retention. The steps businesses can take include carefully and completely examining potential employees' backgrounds for previous examples of dangerous conduct, maintaining supervisory levels sufficient to discourage or detect dangerous conduct, and firing employees exhibiting dangerous conduct.
