Legislation includes the Financial Services Act, and the legislation that applies depends on when products were bought. The decision to move to a personal pension from an occupational scheme should take into account a number of factors such as benefits if death occurs before retirement or within five years of being retired. Annuity purchase decisions involve assessments as to whether the law on age limits will change.

Trustees also have to monitor managers' performance following the appointment.
