The CA Magazine survey of Scottish corporate lawyers

Article Abstract:

Opinions about corporate law in Scotland are presented by the lawyers who were selected as the most effective attorneys in The Accountant's Magazine's survey of 100 senior members of the Scottish financial community. Dickson Minto's Bruce Minto believes that there is no such thing as Scottish corporate law because most laws are applied uniformly throughout the UK. Dickson Minto's Alastair Dickson believes that the Scots have become concerned with discouraging individuals to work in Scotland, and that the country should encourage head offices to move to the north. Corporate lawyers in Scotland are determined to maintain their independence, and Dorman Jeffrey and Co's Brian Dorman believes that corporate lawyers should focus on improving the quality of their services, management, and efficiency, instead of developing multidisciplinary practices.

Professional indemnity insurance

Article Abstract:

Business advisers need to carry professional indemnity insurance due to the increasing amount of litigation affecting UK business. Lawyers have been covered by professional indemnity insurance for a number of years, and other professions, including insurance companies and brokers, are following suit. Alfred Blackmore & Co, a London-based broker, one of many firms offering professional indemnity advice, has opened up an office in Edinburgh. Dir Drew Robertson states that many professionals buying policies believe that it protects them against all situations, but the policies actually have terms and conditions limiting the insurer's liability. New policies are being tailored for specific situations, and are even covering the costs of defending against a suit. Advisers also are offering their expertise on how to handle a law suit.

What you need to know about corporate indemnity

Article Abstract:

Businesses are increasingly being faced with indemnity for pollution and environmental damage, but insurance underwriters typically are hesitant to write policies covering such claims. However, some firms are now offering environmental liability coverage at a much greater cost than traditional policies covering corporate indemnity. This is symbolic of a trend towards innovative coverage for corporate indemnity, including insurance to cover the costs of the defense of a hostile takeover bid, liability insurance for directors, and latent defect insurance covering defects in buildings.
