Article Abstract:

Legal experts working for North Sea oil and gas extraction industries often devise complex contracts with contractors who are carrying out construction work, in order to prevent any claims. A case heard in the UK courts involved Amec Process and Energy Ltd and the construction company Stork Engineers and Contractors BV. Amec was making a claim for damages and price adjustments. The judge suggested the wording of the contract was difficult to understand. But he felt Amec had not relinquished its right to claim damages. Contracts must be made clearer for all parties involved.

Article Abstract:

It is likely further legal cases will be heard, in the UK courts, to establish the law regarding economic loss in negligence cases. A case heard in May 1998 allowed Tunnel Refineries to claim for a compressor damaged by a faulty fan against Alsthom SA even though they did not have a contractural agreement. An earlier case, in 1989, found a contractor was not negligent in failing to oversee the work of a subcontractor which was found to be substandard. The case led to the introduction of collateral warranties into contracts.
