Article Abstract:

Construction industry contracts have become increasingly unmanageable with bulky documents aimed at ensuring that parties' responsibilities and rights are protected. However, it could be argued that such cumbersome documents are acting against the interests of each party and can hinder the legal process. While documents must contain contributions from parties such as quantity surveyors, architects and lawyers, conflicting provisions can be hidden in such complex contracts. Streamlining and simplification of the standard JCT80 is long overdue.

Mixed views are being expressed about the JCT98 form of contract used in the UK construction industry. Some observers feel that JCT98 does not reflect the new focus in the industry on ways of succeeding. They highlight its extension of time clauses, claiming that they merely provide excuses for inefficiency. Other observers agree that JCT98 should be reviewed, but feel that the problem with extension of time provisions is how they are interpreted, rather than what they state.

Delete the blacklists

Article Abstract:

There is increasing concern in the UK construction industry over the blacklists of deleterious materials in contract documents. The solution is to be found in a good practice guide, commissioned by the British Property Federation and the British Council for Offices, which suggests the need for an intelligent and informed approach to materials selection and use.
