Mind the contractual gaps

Article Abstract:

Legal representation may result from inadequate checks made on contracts before work is begun on a construction project. A contract should be checked so as to ensure all parties are in agreement regarding work requirements and specifications. Failure to gain full agreement from all concerned may result in the need for legal intervention and arbitration. Contractors are advised to allow plenty of time to assess contract contents before commencing work.

UK local authorities are warned to give careful consideration to Private finance initiative schemes before entering into a construction contract. The government schemes are likely to be used in a number of local authority contracts including highways, office buildings and waste services. The implications of two legal cases involving local authorities are considered.

The NEC in practice: employers and contractors have reacted very differently to the New Engineering Contract

Article Abstract:

Those using the New Engineering Contract on site will encounter few problems in dealing with contracts drafted in the present tense, although lawyers believe there will be problems arising from some features that have been praised by industry users. The NEC includes a testing and defects clause and the core of the NEC is the compensation events clause.
