New plea for tougher anti-cowboy laws

Article Abstract:

Professional members of the UK construction industry are seeking a change in the law to protect consumers and their own reputations from the damage inflicted by cowboy builders and trades people. The industry is backed by homeowners throughout the country, with up to 89% wanting harsher penalties for those builders who carry out inferior repair work or charge extortionate prices. The Construction Industry Council is asking the government to give greater powers to consumers when seeking redress for poor workmanship, while help could be given to professional firms by reducing taxation levels.

DOE to quell industry fury over bill

Article Abstract:

Senior construction industry officials and experienced lawyers have pointed out that documents supporting the UK government's Construction Bill fail to make a proper distinction between arbitration and adjudication. Government officials are now planning to redraft these documents in order to retain the support of industry bodies. There is particular opposition to the adjudication clause in the 'Scheme For Construction Contracts' documents.

DOE makes U-turn over adjudication

Article Abstract:

The UK construction industry has successfully opposed clauses in the Construction Bill which would have made adjudication into a type of arbitration. Industry representatives had pointed out that adjudication is intended to be a temporary judgment, while arbitration brings a final decision. The government has stated that documents supporting the bill will now not insist that decisions made by adjudicators are binding.
