Nuisance and the builder

Article Abstract:

There are a number of ways in which the law of nuisance in the UK can apply to construction work. In the area of public nuisance, noise from building works is a common problem. However, the law is relatively flexible on this point, accepting that some noise from building works is inevitable. The contractor has a duty to minimize the risk of causing a public nuisance, and must show that reasonable measures, such as the use of debris netting, have been implemented.

Party walls draw the lines

Article Abstract:

The UK's Party Wall Act 1996 is set to be a successful piece of legislation and is unlikely to cause problems for builders or result in extra rewards for building surveyors. The law will mean that disputes in contentious cases will be resolved through statutory means. It is to be hoped the new law will make interested parties think twice about best practice.
