Article Abstract:

Try Construction have introduced a new version of its Domestic Sub Contract/2 which some industry experts have found to be exacting and they suggest that it is not likely to foster good relationships with subcontractors. The contract obliges the subcontractor to retain indemnity insurance for 15 years and Try disclaims any liability if subcontractors are unable to start work on time. Subcontractors must sign the contract before receiving any payments which may be discounted. Try's management defend the conditions in the contract vigorously.

Article Abstract:

The Andrews-weatherfoil construction subcontract is analysed and criticised on several counts. It has been written as a general contractual agreement for primary and secondary subcontracts and is in parts ambiguous. Clause 2 omits the right to extension of time and clause 3 does not specify enough detail on subcontractor responsibility and insurance cover. Other aspects of the contract are discussed.
