The public sector's story

Article Abstract:

The public sector often has problems in following the rules of public procurements for construction work. The Parliamentary Works Directorate was found to have failed in a number of areas in its dealings with Harmon CFEM Facades (UK) Ltd. The public sector bodies should be aware they are not permitted to advertise in the 'Official Journal' if the project is over the threshold but in the early stages of a project they may not be aware of the threshold. The public sector should not negotiate which often causes difficulty between the public sector and contractors.

How-to guides put authors in court

Article Abstract:

The Institution of Structural Engineers faced legal problems when it published a simple guide for engineers doing structural surveys. The Institution had to include disclaimers to protect it and its staff from claims of negligence. It also had to relegate the checklists in the guide to an appendix in order to emphasise their illustrative rather than definitive nature and protect engineers from claims of negligence if they omit one of the points. Professional bodies are discouraged from publishing sensible advice to members because of such legal restrictions.

Article Abstract:

A legal case involving demolition contractors is described with emphasis on reasons for their liability for damage. The case revealed that demolition contractors can be liable when damage is done to an adjoining building even when unforeseen.
