The rules of the game

Article Abstract:

The UK Construction Act has brought adjudication into the construction industry. Adjudication begins when one party to a contract serves a 'notice of intention to refer' on the other and also alerts the adjudicator named in the contract. Under section 108(2), the adjudicator is required to reach a decision 'within 28 days of referral.' However, the adjudicator must state in the confirmation of appointment that day one is the day of appointment. There are still uncertainties over how adjudicators will get paid.

Good intentions

Article Abstract:

The standardization of letters of intent could prevent cases of litigation while creating an industry standard which provides unity within the market. The UK Joint Contracts Tribunal could draw up a standard document which the construction industry would use in the process of all contract construction, reducing the need for disputed cases to end up in court. Letters of intent need to be legally water-tight to prevent contract dispute.
