Article Abstract:

California' Dept. of Insurance and manufactured home lenders are arguing over who has control over insurance proceeds from damages incurred from the 1994 Northridge earthquake. The California Court's ruling on the case of Ziello v. Superior Court held that a borrower is entitled to receive and use the proceeds from the earthquake insurance without interference from the lender unless otherwise stated in the contract. However, this ruling is not applicable to personal property manufactured homes financed by a consumer loan which require a standard mobile home owners insurance policy.

Article Abstract:

The US Supreme Court's decision on the "Ehrlich vs. Culver City case places additional limits on local governments' taking of private property for public use. The Mar. 1996 verdict, which signalled support for property rights, found the $280,000 recreational mitigation fee imposed by city officials of Culver City, CA, on Richard Ehrlich to be unconstitutional taking because it shifted the burden of providing a public benefit to an ordinary citizen.
