Article Abstract:

Construction firms should develop a strategy for tendering. This will be more effective than tendering for as many contracts as possible in the belief that a percentage of them must be successful. Firms should restrict their tenders to work which most closely matches their core competences, they should consider the amount of disruption involved in submitting the tender, and they should consider any prior knowledge of the client. Firms should also construct and present their tenders carefully for maximum effectiveness. The use of information technology will aid this process.

The subcontractors's share: main contractors that claim successfully against an employer may find ways to stop subcontractors receiving their rightful share of the proceeds

Article Abstract:

A serious complaint by subcontractors against main contractors is the failure of the latter to pass on to the subcontractor the share of proceeds of claims against an employer.In two recent cases subcontractors had claimed a share of the settlements in lump sums, and in both cases the main contract was the standard ICE form, with subcontracts in the standard FCEC form. It is also uncertain as to what happens if a main contractor receives windfall sums from an employer, including a sum for the subcontractors.

Use of performance bonds in government construction contracts

Article Abstract:

The UK Government's proposed methods of best practice for government construction contracts and the use of on-demand bonds are supported by professional bodies including the Association of British Insurers and the British Bankers Association. The guidelines suggest that on-demand bonds have a limited use for a particular purpose, for example the retention bond. Departments are advised to use bonds only where absolutely necessary. Other recommendations are listed.
