A postscript to AFTA's false start: the loss of sovereignty issue

Article Abstract:

In order to rectify the defects of ASEAN Free Trade Area (AFTA), there is a need to amend the Agreement's provision on the unilateral and highly discretionary way of determining products to be exempted from AFTA's coverage. An independent body which has the right to determine the compliance of a member state with regards to legal obligations in good faith must also be created. The ASEAN countries' dislike for an independent adjudicatory body could be avoided by removing the binding character of the body's decisions.
