Fixed-fee licensing of innovations and collusion

Article Abstract:

Patent licensing, being a major method where dissemination of innovations occurs, is always analyzed for its possible anti-competitive consequences. However, although licensing agreements with output restrictions, market division clauses or output royalties are perceived to have anti-competitive consequences, fixed-fee licensing contracts of innovations have no such consequences. This type of licensing may facilitate collusion by improving the licensee's ability to credibly punish deviations from the collusive outcome on the part of the licenser.
