Government tendering in Egypt: learning to deal with reality

Article Abstract:

Investors looking to enter into public sector contracts in Egypt should be aware of not only relevant Egyptian law, but the practical problems that arise during the bidding process. Egyptian tender law requires all bids to be submitted through an Egyptian commercial agent. When major capital equipment is involved the government usually requests credit terms with 10% payable when the contract is signed and the remainder paid in semiannual installments. Many of the more problematic aspects of tendering in Egypt occur due to a lack of contractual responsibility for the government purchaser.

Explanatory memorandum for law on disclosure of commissions in government contracting

Article Abstract:

Kuwait's Draft Law on Disclosure of Commissions Offered for Government Contracts is elucidated in an explanatory memorandum. The law aims to safeguard government funds against the greed of public officers and to ensure that public projects are safely and properly implemented. Article 1 indicates the affected entities. Article 2 requires all contracts to be regulated by the Audit Bureau. Article 3 requires the declaration of commissions. Articles 4 and 5 indicate the penalties of violations. Article 6 specifies the Public Prosecution Dept. as governing body with regards to violations.

Government procurement: growing social emphasis on direct contracting

Article Abstract:

The Saudi Arabian government's growing insistence on direct contracts with foreign companies, instead of government-to-government contracts, has made it necessary for companies to be aware of the Kingdom's laws covering issues such as guarantees, advance and partial payments and customs duties. The Saudi government regulations about government procurement, specifically details such as contract breach and termination, product procurement, contract language and testing and inspection, are discussed.
