Interface between anti-dumping policy and competition policy: a case study

Article Abstract:

A study was conducted to analyze concerns associated with the interface between anti-dumping and competition policy using a case that improves the function of competition policy disciplines in the application of anti-dumping policy. Results indicated the importance and difficulties of taking into consideration competition policy issues in anti-dumping initiatives. Findings also showed that a multilateral agreement on competition policy standards will help advance the implementation of anti-dumping concerns.

Cumulation and anti-dumping: a challenge to competition

Article Abstract:

A study was conducted to show how the cumulation provision in GATT/WTO rules makes anti-dumping (AD) an anti-competitive law. The market shares of nations in AD petitions were tallied and analyzed. Results indicated that the country-specific nature of AD protection hindered significantly the effectiveness of AD. Antidumping had become a protective status resulting from increases in the number of cases filed regarding the nature of the cumulation provision.
