Realistic philosophy of the social sciences and economics: a critique

Article Abstract:

Critical realism has become increasingly popular in the social sciences and argues in favor of a normative approach in contrast to positivism. Critical realism tends to assume that social sciences follow positivist priciples but this is not the case since many social scientists adhere to realist principles. Critical realism tends to perceive an external reality, whereas dialogue is important in understanding society. The transformational model of social action (TMSA) is a conservative view of social action and does not take into account the way that individuals can stand back from structures and build up theoretical understanding.

Law and economics in the United States: a brief historical survey

Article Abstract:

The field of Law and Economics is defined as the study of the function of economics in the formulation of legal policy and the study of law through the use of economic methodologies. In the US, Law and Economics as both disciple and movement can be traced to the Progressive movement of 1890-1920. Law and Economics as a social movement is traced to the 1960 publication of Ronald H. Coase's 'The Problem of Social Cost.' Due to its neoclassical and ordinalist tendencies, Law and Economics has not yet developed into an effective instrument for the formation of welfare and legal policy.
